Terms and Conditions

These Terms govern the use of the PicToQuilt web app and the provision of digital content (e.g. quilt patterns as PDFs), unless different provisions apply.

1. Scope

  1. These Terms apply to the use of the PicToQuilt app at pictoquilt.com and to all content and features provided through it.
  2. For the purchase process (payment, invoicing/tax matters, refunds/chargebacks), the terms of the payment processor additionally or primarily apply, where it acts as the seller (see Section 6).

2. Service Description

  1. PicToQuilt enables you to generate quilt patterns from uploaded photos and receive them as digital files (in particular PDF).
  2. The result depends, among other things, on image quality, chosen style, color/detail settings, and technical print/display parameters.
  3. The specific scope of services may evolve (e.g. new styles). Beta features may be limited or temporarily unavailable.

3. User Account, Access, Requirements

  1. Use of the app may require a user account (e.g. login via magic code).
  2. You are obliged to keep your access credentials/links confidential and to prevent unauthorized access.
  3. You may not misuse the app, in particular by automated scraping, circumventing security mechanisms, or placing excessive load on the app.
  4. Use of the app requires an internet-capable device with an up-to-date browser and sufficient storage for downloading PDF files.

4. User Content, Rights to Uploads

  1. You confirm that you hold the necessary rights to the uploaded photos and do not infringe any third-party rights (copyright, personality rights, etc.).
  2. You grant the provider the technically necessary right to process your uploads in order to generate and deliver the pattern to you.
  3. You may delete uploads where the app provides this option. (Note: technical backups/logs may be deleted with a delay.)

5. License to Generated Results (Private Use Only)

  1. The patterns/PDFs provided are intended for your private, non-commercial use.
  2. Permitted: printing and using patterns for your own sewing, or as a personal gift in a private context.
  3. Not permitted without prior written consent from the provider: selling or distributing PDFs/patterns to third parties (even for free); publishing or uploading PDFs/patterns (e.g. in groups, forums, cloud shares); using them to manufacture products for sale, for workshops, course materials, series production, or any other commercial purpose.
  4. Commercial use: If you wish to use the results commercially, please contact support@pictoquilt.com for an individual licensing offer.

6. Prices, Payment, Merchant of Record (Lemon Squeezy)

  1. Prices are displayed in the app and on the landing page.
  2. Payments are processed via Lemon Squeezy. Lemon Squeezy acts as Merchant of Record. This means, among other things, that the purchase contract and payment transaction run through Lemon Squeezy, and Lemon Squeezy assumes responsibility for the purchase process (e.g. taxes, refunds/chargebacks, PCI compliance).
  3. The Buyer Terms of Lemon Squeezy additionally apply.
  4. For support regarding the app or PDF content, your contact remains: support@pictoquilt.com.

7. Delivery of Digital Content, Availability

  1. Digital content is made available in the app after successful payment (PDF download).
  2. There is no entitlement to uninterrupted availability at all times. Maintenance, updates, or disruptions may cause temporary limitations.
  3. The provider may modify individual features or styles, provided the essential character of the service is maintained.

8. Withdrawal / Refunds (Consumers)

  1. If you are a consumer in the EEA or UK, you have a statutory right of withdrawal. For digital content, this right ends once you begin performance of the contract (e.g. by downloading the PDF) and have expressly acknowledged to us that you are aware the right of withdrawal will end.

  3. Refunds/chargebacks are generally handled through Lemon Squeezy as part of the purchase process (MoR).
  4. Regardless, you can always contact support@pictoquilt.com if you have a problem; we will help you find an appropriate solution.

9. Warranty, Liability

  1. The provider is liable without limitation for intent and gross negligence, and for injury to life, body, or health.
  2. In cases of ordinary negligence, the provider is only liable for breach of material contractual obligations (cardinal obligations), and liability is limited to typical, foreseeable damage.
  3. No liability for print or color deviations caused by end devices, printers, paper, settings, or software viewers.
  4. You are responsible for checking results before final cutting or sewing (measurements, scaling, print settings).

10. Suspension, Termination

  1. In case of violations of these Terms (e.g. unauthorized distribution or commercial misuse), the provider may suspend or terminate access.
  2. Statutory claims remain unaffected.

11. Accessibility

  1. We strive to make the app accessible. If you encounter barriers, please contact us at support@pictoquilt.com.

12. Changes to the Terms

  1. The provider may update these Terms if required for legal or technical reasons, or if the scope of services evolves.
  2. Material changes will be announced; continued use of the app constitutes acceptance of the updated terms.

13. Final Provisions

  1. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG), to the extent permitted.
  2. If any provision of these terms is or becomes invalid, the rest of the contract remains in effect. The invalid provision shall be replaced by a valid one that comes as close as possible to the economic purpose of the invalid provision.
